ASSUMPTION OF RISK, WAIVER OF LIABILITY, and INDEMNIFICATION AGREEMENT and PRIVACY CONSENT & PRIVACY POLICY

By entering into the SPORT BEACH event (the “Event”), you consent to the terms set forth herein.

GENERAL TERMS

I understand and agree with the following:

  1. That there is some risk in attending and participating in activities at or hosted by Sport Beach LLC (and together with its affiliates, “Sport Beach”) related to the Sport Beach Event held between June 21 and June 25, 2026
  2. That I am voluntarily participating in the Event and I accept all of the risks associated with such participation. Accordingly, I hereby waive and release Sport Beach and its employees, its contractors, its insurers, officers, directors, all Event sponsors and their representatives (collectively, the “Indemnitees”) from all claims as well as any losses, demands and damages (collectively, “Damages”) resulting from my attendance at and/or participation in the Event. Notwithstanding the foregoing, if it is finally determined that Sport Beach does have any liability resulting from my attendance at the Event, I understand that Sport Beach’s aggregate liability to me for any Damages will not exceed $100. The limitations in this section shall not apply to Damages caused by the gross negligence or intentional misconduct of Sport Beach. I expressly agree to indemnify and hold the Indemnities harmless against any and all Damages that result from my acts or omissions while participating in the Event.
  3. That the Indemnitees are not responsible or accept responsibility for any property that is lost, stolen, or damaged while in, on, or about the premises of the Event.
  4. I agree to abide by any decision of a Sport Beach employee relative to any aspect of my participation in these activities, including the right of any official to deny or suspend my participation for any reason.
  5. That the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of New York, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

CONSENT TO USE MY IMAGE

I expressly consent to Sport Beach using my image, whether via photographs, motion pictures, recordings or any other record of my participation in the Event in any medium for any legitimate purposes, including, but not limited to, promotional content regarding the Event or other material produced by Sport Beach regarding the Event. My consent also includes the use of my image by authorized partners of Sport Beach. Such consent is made without any compensation other than my participation in the Event. Such consent shall be for a reasonable time period of not more than three years from June 25, 2026.

This consent shall be governed by, and construed in accordance with, the laws of New York, United States and the courts of New York shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions.

USE OF DATA WE COLLECT

Sport Beach is the “Controller” of the Personal Data you supply to Sport Beach. Personal Data includes, but is not limited to your name, email address, title and company as well as your location within the the Event venue (via a RFID tag in your Event badge).

Sport Beach may and you authorize Sport Beach to use your personal information for the following purposes:

  • Marketing.
  • Communicating Sport Beach activities and news.
  • Sharing with third-parties (including but not limited to the Event sponsors and partners) for marketing purposes.

You further authorize Sport Beach to share your Personal Data with third party software providers who collect, store and process your personal data on behalf of Sport Beach and who are contractually obligated to keep your personal data confidential subject to appropriate safeguards to prevent it from unauthorized disclosure.

If your personal data is collected in the European Union, your personal data will be transferred out of the European Union to Sport Beach located in the United States.

Sport Beach will store your Personal Data in accordance with the record retention requirements applicable to U.S. laws. Under the EU GDPR, you have the right to request access to, rectify, erase and restrict the processing of your personal data. You also have the right to revoke this consent to use your personal data. If you feel Sport Beach has violated the EU GDPR, you have the right to file a complaint with the appropriate EU supervisory authority.
